Commercial Litigation
Litigation can have a significant impact on a company's ability to achieve its business objectives. I help companies involved in commercial litigation assess their options and make decisions consistent with their goals. I have represented companies in complex litigation and alternative dispute resolution proceedings across a broad range of industries, from health care providers and consumer products to financial services and automobile dealers. I aggressively defend my clients' interests in matters such as breach of contract, consumer fraud and false advertising claims, corporate governance, and mergers and acquisitions.
Corporate
Eminent Domain
The right of eminent domain, also known as "condemnation", is the right of the state, through its regular organization, to reassert, either temporarily or permanently, its dominion over any portion of the soil of the state on account of public exigency and for the public good. I represent clients in all aspects of an eminent domain proceeding.
Land Use
Zoning is the division of a city by legislative regulation into districts and the prescription and application in each district of regulations having to do with structural and architectural designs of buildings and of regulations prescribing use to which buildings within designated districts may be put. I help clients interact with governmental entities in issues of zoning, control of Real Estate development and use, environmental impact studies and land use planning laws which are implemented by local zoning and land use laws and ordinances.

Residential and Commercial Real Estate
I have been providing a full range of Real Estate law services to commercial and individual clients in Monroe County, the Poconos Mountains area, and throughout northeastern Pennsylvania since 1970. Not only do I have an extensive understanding of Real Estate law, but I also know the reputations of the various builders, developers and real estate agents in the Poconos area. This is a critical asset during a Real Estate closing.

On the commercial side of my Real Estate practice, I work with developers, owners, property managers, tenants, financial institutions and investors in all types of transactions from routine purchase agreements to complicated development plans. Among my clients are corporations, local buyers and sellers of real property, landlords and tenants, and investment and property-management companies. My practice includes:

  • Acquisitions
  • Brokerage commission disputes
  • Construction-contract issues and litigation
  • Contract negotiations
  • Environmental remediation
  • Foreclosures and Defense of Foreclosures
  • Lease negotiations and contracts
  • Loan workouts
  • Project finance, including mortgages, sale-leasebacks, like-kind exchange and non-traditional financing sources
  • Property-management issues
  • Title-insurance matters
  • Zoning issues
I also assist individuals in the process of buying or selling a home, co-op, or condominium. I provide clients with an all-inclusive service all the way from preparing and negotiation a contract of sale to coordinating with the title insurance company to insure a risk-free transaction. Without the proper legal guidance, the process can be frustrating, overwhelming and more costly than necessary. When you retain me you not only get the technical competence you require, you also benefit by my extensive experience in dealing with the human element in Real Estate transactions. I can resolve problems in a practical way.

My Real Estate practice also includes assisting clients involved in eminent domain proceedings. The right of eminent domain is the right of the state, through its regular organization, to reassert, either temporarily or permanently, its dominion over any portion of the soil of the state on account of public exigency and for the public good.
Small Business
There are various forms of business organizations available to those who wish to enter into a business venture. Based on my extensive experience, I will provide counsel in selecting and creating the proper business organization that will best meet your needs. I am experienced in preparing and filing al the required documents for a variety of business entities, including:

  • Sole proprietorships
  • Partnerships (including Limited Partnerships and Limited Liability Partnerships)
  • Corporations (including Subchapter S Corporations and regular so-called "C" Corporations),
  • Limited Liability Companies ("LLCs").
I also provide the legal services that you and your business need to thrive. I provide advice and consultation and assist my business clients in drafting whatever documents are necessary, including contracts, leases, buy-sell agreements, trademarks and trade names, covenants not to compete, employment and confidentiality agreements and stock option and other benefit plans. I review and analyze proposed corporate agreements mandated by your suppliers and customers and assist in employee and labor relations. Should disputes arise in conducting your business, I am an aggressive advocate whether pursuing your claim or defending a claim brought against you.

Trusts and Estates
I handle a variety of estate planning matters for individuals with estates under $1 million, including planning for the distribution of an individual's property at his or her death and taking into account wills, taxes, insurance, property, and trusts so as to gain the maximum benefit of all laws, while, at the same time, carrying out the person's wishes. By way of example, estate planning may include wills, spousal and children's trusts, insurance trusts, special needs trusts, revocable living trusts, irrevocable trusts, advance medical directives, powers of attorney (general, special and medical), as well as an array of sophisticated planning techniques used to protect assets from unnecessary probate costs and taxation.

In addition to estate planning, I also assist clients with Probate and Estate Administration. Probate is the legal process by which a person's debts are paid and assets are distributed upon her or his death. Estate Administration includes the probate process as well as non-probate transfers of the deceased's assets. Individual state laws direct the probate court how to distribute the deceased's estate. State laws and procedures vary greatly, so, it is important to consult an attorney with expertise in this area of the law to ensure that the deceased's assets are distributed correctly.

Lemon Law
I am well versed in Unfair/Deceptive business practices matters. I pursue a full range of consumer complaints against banks, real estate brokers, motor vehicle dealers, and other businesses.

Motor Vehicle Accidents
I have represented a large number of automobile accident victims. I take great pride in limiting my representation to plaintiffs and in representing no insurance companies involved in these claims. I am committed to treating each case, large or small, with the seriousness it deserves in order to assure that each of my clients receives the compensation that he or she deserves.
